6. Copyright, intellectual property & image usage
Client commissioned works (“on the job”):
- Photographs and video footage taken “on the job” (defined as within the agreed date, time scale, and geographical confines of the commission) become the exclusive property of the Client upon receipt of cleared, full payment.
- We will execute any standard transfers or assignments of rights required to reflect this ownership.
Third-party & website usage: We will not place client commission images online or on third-party websites without express written permission (via email, messaging, or written brief).
Portfolio rights: The Client agrees that Boost Media Marketing / Bromley Photography may reference the project in portfolios, showcase the work in business case studies, or display selected images with prior client approval.
General locality & stock photography: Imagery captured outside the specific confines or remit of the client’s commission (e.g., general street scenes, landmarks, or local stock photography) remains our exclusive copyright and may be added to public or free stock libraries (such as Pexels).
7. Quality, review & remedy process
Artistic discretion: The Client acknowledges that photography and videography are creative services involving personal style and professional discretion regarding framing, lighting, and editing style.
Samples & corrections: Digital proofs/samples will be shared before final delivery. Any reasonable correction requests (e.g., crop adjustments, exposure balance within standard post-production hours) must be submitted within 14 days of sample delivery.
Rectification first: If the delivered files fail to meet agreed specifications, you must notify us within 14 days. We must be given a reasonable opportunity to review and rectify editing issues prior to any dispute or refund claim.
8. Limitation of liability
Public liability: We maintain valid Public Liability Insurance.
Data & equipment failure: While industry-standard backups and equipment maintenance are observed, in the unlikely event of technical camera failure, SD card corruption, or accidental loss of footage prior to delivery, our aggregate liability is strictly limited to a free re-shoot or a full refund of monies paid for the affected service.
Consequential loss: To the fullest extent permitted by law, neither party shall be liable for indirect, incidental, or consequential damages (such as loss of profits, commercial opportunities, or secondary event disruptions).
9. Governing law & jurisdiction
These Terms and Conditions and any dispute or claim arising from them shall be governed by and construed in accordance with the laws of England and Wales. Both parties irrevocably submit to the exclusive jurisdiction of the courts of England and Wales.
